The oracle text on the Born of the Gods card, Phenax, God of Deception states that Phenax is not a creature if your devotion to blue and black is less than 7. However, the card is a Legendary Enchantment Creature, so if your devotion is not enough for Phenax to be a creature, would casting it be a creature spell (could it be countered by Nullify or other cards that specifically counter creature spells)?

9/15/2013: The type-changing ability that can make the God not be a creature functions only on the battlefield. It's always a creature card in other zones, regardless of your devotion to its color.


Yup, you can counter it with stuff like {essence scatter}.
