I would say yes.. Anytime during the draft you can use him. He goes back into the pack when you do.

No you cannot. They will be for legacy and vintage only, except the conspiracy cards which are only legal in drafting. Usually the whole set of cards is released a week or 2 before pre-releases and actual release right?
