Deathtouch + Activated abilitys

Ok so my friend sould bounded his {Nightshade Peddler} with {Falkenrath Exterminator} and claims that when ever his exterminator uses his ability that it has deathtouch and kills any of my creatures for 3 mana. Now I know tht deathtouch is for combat damge only. He and one oter person say a judge ruled that okay at the pre release. Now please help me understand how this could be possible.
