Now if you take a creature with first strike and deathtouch to fight a creature using Prey Upon does it still use it's deathtouch and first strike? A judge told me that it still does have those abilities but he also told me he wasn't sure can someone clarify?

Death Touch: yes.
First Strike: no.
Fight - Each deals damage equal to its power to the other.
The creature is dealing damage, so anything regarding that applies. Infect, deathtouch, lifelink, etc. First strike is strictly for combat.
Ahh so that counts out double strike too. Well ok then that's annoying
